RULES GOVERNING MAIL-ORDER SALE IN THE MEDBOOK.COM.PL BOOKSHOP

GENERAL PROVISIONS

  1. These Rules shall be binding on the occasion of entering into transactions by and between medbook.com.pl store and consumers purchasing products via medbook.com.pl internet store with the view of using them and not for the purpose of further resale within the framework of their business activities.

  2. The Internet store operating at the following address: www.medbook.com.pl, is run by Medyceusz Spółka Cywilna, with its registered address in Gdańsk at ul. Hoene-Wrońskiego 1, NIP (Tax Registration No) 957-062-00-52, Regon 191399726, entered into the register of business activities maintained by the President of the City of Gdańsk, under the identification number 99394.

  3. The address where the activities are run is also the correspondence address of the seller.

    OFFER

  4. All products offered in the medbook.com.pl Internet store are brand new, free from physical and legal defects and have been legally introduced into the Polish market.

  5. All prices featured in the store are expressed in the Polish zlotys (PLN) and are gross prices (VAT included).

  6. The contents of the medbook.com.pl store website does not constitute an offer within the meaning of the provisions of the Civil Code – it serves exclusively as trade information. The store reserves the right to change the prices of goods included in the offer, to introduce and to remove goods from the store’s offer, to carry out and to cancel promotional activities on the store’s website or to introduce changes thereto.

  7. The medbook.com.pl team shall undertake all reasonable efforts in order to make the descriptions and technical specifications of the products available in the store reflect the reality. We shall not, however, be liable for any situations where the manufacturer has provided us with incorrect parameters and characteristics of any product or where such information have been suddenly changed by the manufacturer. However, in every case when such information (including descriptions and technical specifications of products) presented on the store’s Internet website on the day when the order was made by the client was not consistent with reality, the client shall be entitled to rescind the contract within 30 days from the date of purchase.

    ORDER

  8. The orders shall be placed via the medbook.com.pl website, via e-mail at the following address: orders@medbook.com.pl, by phone (+48 58) 732-19-72 or by fax (+48 58) 341 54 38, extension 23.

  9. An order shall be executed on condition that all data required in the information form have been correctly entered, and in particular if the telephone number or an e-mail address allowing to confirm the order have been provided. The store reserves the right to verify such data.

  10. In justified cases the Shop reserves the right to refuse to execute the order, to limit the method of payment or require an advance payment.

  11. Payment for ordered products may be performed in cash upon delivery, by credit card or by a bank transfer.

  12. Should payment by a bank transfer be selected, the following procedure shall apply: upon ensuring availability of all ordered goods the store informs the client thereof by e-mail or by SMS and on the basis of this information the ordering party shall make an advance payment to the seller’s bank account in PKO BP S.A. O/Gdańsk, account No PL 27 1020 1811 0000 0102 0017 9390, SWIFT (BIC Code): BPKOPLPW. Upon reception of a confirmation that the funds have been credited to the account, the store shall send the ordered goods to the address specified in the order.

  13. Upon placing the order the client shall receive an e-mail confirming that the order has been accepted. The execution of the order shall commence: a) in the event of orders payable by credit card – upon authorisation of payment,b) in the event of orders payable by a bank transfer – as soon as the money has been credited to the store’s bank account.

  14. A receipt or, upon request, a VAT invoice, shall be issued in relation to every order. The sales document is issued when all the goods ordered by a particular client have been collected and are ready for dispatch.

  15. The client may introduce changes to the order or to cancel it until the dispatch of goods. The changes may be made by phone (+48 58) 732-19-72 or by fax (+48 58) 341 54 38, extension 23 or by e-mail sent to the following address: orders@medbook.com.pl.

  16. The client may not cancel the order if the goods have already been sent.

  17. Postage costs calculated according to the principles specified in the “Help” section shall be added to the value of the ordered goods. The total value of the order shall be equal to the value of the ordered goods plus the cost of delivering them. The delivery of goods shall take place in the way selected by the client and specified in the order.

    DELIVERY

  18. The time needed for the execution of the order shall be specified for each product. The presented value indicates the time which usually passes from the moment when the order is placed until the time when the ordered products are dispatched from the store, which includes only working days. An order relative to products with various execution periods shall be dispatched when it is complete, that is within the longest of the specified periods.

  19. The purchased goods shall be considered handed over the moment they are transmitted to the representative of a forwarding company or when they are collected in person at the seller’s registered address. Detailed information about delivery methods, period and costs is available in the „Help” section of the website.

  20. The client shall, in the presence of the representative of the forwarding company, check the contents of the delivered letter or parcel in the context of any mechanical damage which might have been incurred during transport. Should such damage be discovered, the client shall demand that a complaint report is drafted.

    COMPLAINTS

  21. All products are in any case covered by a 12-month seller’s warranty provided on the terms and conditions resulting from the provisions of the Civil Code.

  22. If, after reception of the goods, the client finds any technical defects or any damage caused during delivery, he or she shall return the goods by post to the address of the store. The store shall not accept any letters and parcels returned COD or in relation to which the postage costs have been charged on the store without any prior agreement.

  23. The costs related to returning the goods covered by a complaint shall be reimbursed by the store immediately upon reception of the goods and examination of the complaint. The returned goods shall be accompanied by a document confirming purchase (a receipt or an invoice). All complaints shall be examined at the latest within 3 working days from the day have been received.

  24. Damaged goods shall be replaced with non-damaged goods and should this prove to be impossible, the store shall reimburse the buyer with the equivalent of the price of the returned item.

  25. Performing the check of the delivered letter or parcel upon reception thereof shall be an indispensable condition for accepting any possible claims made by the client in relation to any damage or loss incurred in transport.

  26. In the event of an unjustified complaint all the costs of carrying out the procedures specified hereabove shall be covered by the client.

    RETURNING GOODS

  27. Pursuant to the provisions of the Act on Protection of Certain Consumer Rights and on Product Liability of 2 March 2000 the client may resign from keeping a product purchased in our store without invoking any grounds for doing so within 10 days from the day when the letter/parcel was collected.

  28. The above is possible only when the product was not used or copied and has not been damaged in any way. CDs, DVDs and MC cassettes shall be returned in their original, intact packaging.

  29. The goods to be returned shall be sent back together with the obtained sales document and a written declaration of willingness to return the goods. The store guarantees reimbursement of the amount equal to the price of the goods. The relevant sum shall be reimbursed within 10 working days by a bank transfer to the account indicated by the client or by a postal money order to the address indicated in the order – in this case the seller shall deduce handling costs calculated and charged by the Polish Post from the amount to be reimbursed.

  30. The cost of delivery and returning the goods shall not be reimbursed.

    FINAL PROVISIONS

  31. When placing the order the client consciously gives his or her consent to processing and using his or her personal data within the scope necessary for the execution of the order.

  32. Personal data placed in the database of medbook.com.pl store are processed exclusively for the store’s purposes and are not and will not be made available to other entities. These data is collected with due care and is adequately protected from access of unauthorised persons, pursuant to the provisions of the Personal Data Protection Act dated 29 August 1997 (Journal of Laws of 1997 No 133 item 883). The client is entitled to have access to his/her data, to correct it and to demand that it is no longer used.

  33. Any issues not covered by the provisions of these Rules shall be governed by the provisions of the Civil Code and the Act on Protection of Certain Consumer Rights and on Product Liability of 2 March 2000.

  34. All disputes arising in relation to the performance of the sale and purchase agreements entered into by and between the seller and the consumers shall be first settled by means of negotiations, with an intention of arriving at an amicable settlement of a dispute. Should amicable settlement of a dispute prove to be impossible, such a dispute resulting from the agreement shall be settled by a court competent for the registered address of the seller.
